Back in January, I noted that the FMCSA was planning on making some slight changes to the whole, “Driving while Disqualified” violations.  Many of your drivers were being disqualified over non-safety related things: unpaid parking tickets, legal fines, etc.

Well, earlier this month, the FMCSA announced that they have made changes to their system.  They will now take into consideration if the suspension was dispensed by the license-issuing state and if the violation was safety-related or not.  Please check the FMCSA’s site for more information, but until then, here’s the general table for the new Severity Weights.

Violation Before ASPEN Enhancement (Severity Weight) Violations After ASPEN Enhancement (Severity Weight)
383.51(a) Driving a CMV (CDL) while disqualified (8) Driving a CMV (CDL) while disqualified (Safety/State of Record) (8)
Driving a CMV (CDL) while disqualified (Safety/Not State of Record) (5)
Driving a CMV (CDL) while disqualified (Non-Safety/State of Record) (5)
Driving a CMV (CDL) while disqualified (Non-Safety/Not State of Record) (1)
391.15(a) Driving a CMV while disqualified (8) Driving a CMV while disqualified (Safety/State of Record) (8)
Driving a CMV while disqualified (Safety/Not State of Record) (5)
Driving a CMV while disqualified (Non-Safety/State of Record) (5)
Driving a CMV while disqualified (Non-Safety/Not State of Record) (1)

Bad news, this will NOT be retroactive.

Better news, the FMCSA has a Facebook page :)
